Question about Infraction System and Temporary Bans

On one of the forums I admin, we have a number of infractions set up with varying points and the default is set to expire after 10 days.

Now, an infraction that puts the member over 10 points triggers an automatic temporary 3 day ban.

When the temporary ban expires, the member comes back but still has over 10 points that haven't yet expired.

What is supposed to happen in this case? Should the next infraction he gets trigger a check of in fraction points that in turn triggers another temporary ban? Or does he in some way get set to "zero" after the first temporary ban (he still shows something like 16 unexpired points)?
