There is no legal guarantee of Freedom of Speech on privately owned websites or business property. The Bill of Rights doesn't apply. Delete the spam, ban the user, don't correspond with them.
If you're running a website for a government agency, you might want to discuss it with counsel. However on a private site, the question is moot.Translations provided by Google.
