Are smiles copyrighted?

i'm thinking of putting some MSN smiles instead of the default ones and was wondering if they are copyrighted ?!?!?

just because somthing free does not mean its free for use in other things.

"Everything" is copyrighted in one fashion or another, just because it does not have the (C) symbol does not mean it's not.

If you produce anything, it is automatically copyrighted to you. So the question should be not is it copyrighted, but are you allowed to use them. For that answer you need to ask permission from the original creator.
