View Full Version : How do you handle banning subscribers?

I just began accepting subscriptions for ad-free browsing and more features on my forum. It never really crossed my mind how to handle banning or reprimanding unruly users who are paying to access the site. How do others out there handle this situation? Are there any other unexpected legal issues that you have encountered while offering subscriptions?

I have stated that there are no refunds for subscriptions.

IMO, you should add a notice before they signup that they can be banned and all forum rules still apply. They won't be refunded their money if they break rules, and you can and will ban them for any reason you may have, with or without their consent. Put a checkbox or something so that they have to click on something (maybe an I Agree button?) for it to go away and for them to subscribe. This way, if someone is breaking your rules or being an ass and its a subscriber, you can still ban him and say that s/he agreed to those terms and they can't do anything about it.

Legally you can also put in a blank field, and have them type their name, and it legally counts as a contract.

But then in many countries it could be considered revenue for providing services and it could be taxed.

If you are giving someone a service or an upgrade in return for money you are making a sale and thus you are subject to be taxed (you can't claim payments to the nra or aclu as deductable for this reason). Your best bet is to have a clear TOS which explains your refund policy and your treatment of paid members, that should be enough should one ever push the limits.
